Dealing With Shady Nursing Home Neglect Issues
Tuesday, March 24th, 2009When nursing homes start to neglect patients, they cross very real legal bounds that can get them in a lot of trouble. After all, neglect can lead to deaths and severe illnesses that end up causing grief for the family related to the patient. Even something small like bed sores may give you a case.
There are laws being put into action among states each year that cracks down on how nursing homes can operate. Some states will even require that a nursing home subject their patients to an interview with a coroner to help determine the cause of death. If any indication of neglect is found, the coroner is then able to bring a case against them- but not all states have such good legislation.
Even something as seemingly small as bed sores can be considered neglect, and the suffer may be entitled to a real case against the nursing home. This is common among immobile residents who are disabled and can’t move. If their body is not shifted around frequently, the sores will begin to develop. This is an obvious case against the nursing home, who should be paying more attention.
Proper food and water is also required if the elderly are to live a peaceful life. While water isn’t usually a problem, some nursing homes have cut back on spending and have supplied only meager meals to their patients. This can be a dangerous game, as malnutrition can quickly lead to serious health complications among the elderly. If the cause of death was dehydration or malnutrition, you may also have a case.
Frightening enough, some nurses will abuse or physically harm patients. These types of people should have been weeded out in the interview process, but some nursing homes are either corrupt or too short handed on staff to deny them a job. If that is the case, the nursing home is at fault for any type of crimes committed. Stay in close interaction with family members to avoid such a situation, and report and indication of a crime as soon as you hear it.
Some cases would make it questionable as to whether or not a patient is liable for damages, or if the nursing home is. One case would be if the patient were to escape and become injured. This would actually make the nursing home at fault in most cases, since they assumed responsibility in caring for the patient, and should have proper defenses against someone simply walking out of the facility.
Final Thoughts
Nursing homes shouldn’t be a prison for the elderly- they should be peaceful institutions that are in place to make life easier for everyone. If you suspect that a nursing home has been neglecting a friend or family member, you should start investigating your options in making a legal case.
